Terms of Service

These Terms of Service ("Terms") govern your access to and use of PitchCentric (pitchcentric.com), a product of Centric Labs ("Centric Labs", "we", "us"). By creating an account or using the Service you agree to these Terms.

1. Eligibility

You must be at least 18 years old and capable of forming a binding contract to use the Service. If you are using the Service on behalf of a company, you represent that you have the authority to bind that company.

2. Acceptable Use

You agree not to:

• Use the Service to send unsolicited commercial email (spam) in violation of CAN-SPAM, GDPR, CASL, or any other applicable anti-spam law.
• Scrape, copy, or resell the podcast catalogue data without written permission.
• Attempt to access accounts or data that are not yours.
• Use the AI pitch generation feature to create content that is false, defamatory, or impersonates another person.
• Circumvent rate limits, access controls, or billing systems.
• Use the Service in any way that violates applicable law.

We reserve the right to suspend or terminate accounts that violate these rules, with or without notice, at our sole discretion.

3. Payment Terms

Paid subscriptions are billed monthly in advance. All prices are in USD. Taxes may apply depending on your jurisdiction.

Your 15-day free trial starts on the day you subscribe. A card is required at signup. If you do not subscribe before the trial ends, your account is paused and your data retained for 30 days before permanent deletion.

Subscriptions renew automatically unless cancelled before the renewal date. You may cancel at any time through the billing portal. Cancellation takes effect at the end of the current billing period.

4. Refund Policy

We offer a pro-rated refund for any unused days remaining in a billing period only in the following circumstances: (a) service outages exceeding 24 cumulative hours in a billing month directly attributable to our infrastructure, or (b) within 48 hours of your first paid charge if you have not generated any AI pitches or sent any emails.

All other charges are non-refundable. Please contact hello@pitchcentric.com for refund requests.

5. Intellectual Property

Our IP

PitchCentric, the Booking Probability score, and all underlying software, algorithms, and designs are owned by Centric Labs. Nothing in these Terms transfers ownership of our IP to you.

Your content

You retain ownership of your profile, bio, and any content you create using the Service. By using the Service, you grant us a limited, non-exclusive licence to process your content as necessary to provide the Service (e.g. to generate pitches, compute match scores).

AI-generated content

AI-generated pitches are produced using third-party AI APIs. You are responsible for reviewing, editing, and ensuring the accuracy of any AI-generated content before sending it. We make no warranty that AI output is accurate, appropriate, or fit for any particular use.

6. Limitation of Liability

To the maximum extent permitted by applicable law, Centric Labs and its officers, employees, and contractors are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to lost bookings, lost revenue, or reputational damage.

Our total liability to you for any claim arising out of or relating to these Terms or the Service is limited to the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) USD 100.

7. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that any particular podcast booking outcome will result from using the Service.

8. Termination

You may delete your account at any time from the settings page. We may terminate or suspend your account immediately if you breach these Terms, fail to pay, or if we are required to do so by law. Upon termination, your right to use the Service ceases immediately. Sections 5, 6, 7, 9, and 10 survive termination.

9. Governing Law & Dispute Resolution

These Terms are governed by the laws of the Dubai International Financial Centre (DIFC), UAE, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms shall be resolved by binding arbitration in Dubai under the DIFC-LCIA Arbitration Rules. Nothing in this clause prevents either party from seeking injunctive relief in any court of competent jurisdiction.

10. Changes

We may update these Terms at any time. Material changes will be communicated to registered users by email at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the new Terms.
