On May 10, 1872, Ulysses S. Grant signed a law declaring the mineral wealth of America's public lands "free and open to exploration and purchase." It is still the law. A company mining a billion dollars of gold, copper, lithium, or uranium on federal land pays the United States a production royalty of exactly zero — alone among extractive industries on public land. The statute contains not one word about cleanup. Episodes one through nine lay out the evidence and give the industry's case its full weight. Episode ten renders the verdict. The host has a personal stake: in 1976, doing Forest Service research in Idaho's Nez Perce National Forest, he was held at gunpoint by a mining family acting on their understanding of this law.
